EMM Bylaws

This By-Law provides for the provision and regulation of Library and Information Services, including membership, loan and return of all library media, loss of media by n member, use of internet facilities at the facilities, hours, nonliability of personnel with respect to minors using the facilities and library hours, within the Ekurhuleni municipal area and to provide for matters incidental thereto.

This By-Law provides for the planting, pruning, removal and treatment of street trees, as well as pest control, replacement value and penalties of these trees within the Ekurhuleni municipal area and to provide for matters incidental thereto.

This By-Law provides regulation of traffic related matters; to provide for the regulation of taxis; to provide for the control and regulation of signs and advertisements; to provide for the regulation of street trading; to provide for the control of parking grounds and meters as well as parking attendants and car watchers; all within the municipal area of the municipality and to provide for matters incidental thereto.

This By-Law provides for the environmental health standards to prevent disease within the Ekurhuleni municipal area, including prolonged life, protect and promote the health and well-being of people and to provide for matters incidental thereto.

This By-Law gives effect to the implementation of the Ekurhuleni Metropolitan Municipality’s Rates Policy and to provide for matters incidental thereto.

This By-Law provides for the regulation of parks and open spaces within the municipal area of the municipality, including the control to, behavior in, damage to, entertainment, animals, vehicles, trading in, camping, angling and penalties and to provide for matters incidental thereto.

Provide for the collection and removal of refuse for residents within the municipal area of the municipality including businesses, industrial, hazardous and building refuse. The By-Law also deals with the use of all types of collection and transfer centers and to provide for matters incidental thereto.

Provide for the use and administration of municipal sport and recreation facilities within the municipal area of the municipality, including the hours, charges, equipment use, floodlights, liability, right of admission and conduct, as well as temporary liquor and music licenses, and to provide for matters incidental thereto.

This By-Law To provide for the management and regulation of waste water within the municipal area, including compulsory provision of sewerage, common drains, unauthorized drainage work, unlawful drainage work duty of maintenance, prevention of blockages, clearing of blockages, emission of gas or entry of sewage, work by Council, interference with sewer, disused conservancy and septic tanks obstruction and false Information and to provide for matters incidental thereto.

This By-Law provides for the provision, management and regulation of
water supply to both businesses and residents within the municipal area
of the municipality and to provide for matters incidental thereto.

This By-Law provides for the use and regulation of the Benoni Museum, the Springs Civic Theatre as well as Art Galleries and Community Art Centers, within Ekurhuleni.

This By-Law governs the permission to bury, application procedure for burial in a Council cemetery, coffins, number of bodies in a coffin, body bags, numbering of graves, reservation of graves in a Council cemetery, transfer rights in Council cemeteries, burial of ashes, burial of indigent, burial or cremation of paupers, recording of burials, military graves and heroes acres and burial registers.

Provide for the provision and regulation of Library Auditoriums and Group Activity Halls within the municipal area of the municipality and to provide for reservations, payment of charges, free use, provision of furniture, equipment and crockery, condition of leasing, cancellation of reservations, damage to Council property, indemnity and matters incidental thereto.

This By-Law governs to ensure that all monies due and payable to the Council are collected; to provide for customer management, credit control procedures and mechanisms and debt collection procedures and mechanisms; to provide for indigents in a way that is consistent with rates and tariff policies and any national policy on indigents; to provide for extension of time for payment of accounts; to provide for charging of interest on arrears, where appropriate; to provide for termination of services or the restriction of the provision of services when payments are in the arrears; and to provide for matters relating to unauthorized consumption of services, theft and damages within the municipal area of the municipality and to provide for matters incidental thereto.

Provide for the supply and usage of electricity within the municipal area of the municipality, including termination of consumer’s agreement, continuation of supply to new consumers, deposit reading of meters, prepayment metering, testing of meters, disconnection of supply, unauthorized connection, liability of Council and contractor, tampering, complaints of failure of supply, owner’s and consumer’s liability, notices offences and penalties and  and to provide for matters incidental thereto.

Provide for the provision and regulation of Emergency Services within the municipal area of the municipality, including administrative provisions, fire protection and firefighting, dangerous goods, construction of vehicles, as well as transportation and transport permits, storerooms for dangerous goods, spray painting and spraying permits, animals, penalties and to provide for matters incidental thereto.

This By-Law provides for the operation of the Ekurhuleni Fresh Produce Market (Springs), including business hours, risk of profit and loss, control and risk of produce, packing, stacking and display of produce, cold storage and ripening, abandoned produce, produce unfit for human consumption, market agents and their employees, automatic lapse of a market agent’s licence, salespersons, floor sales, payment retailers and wholesalers, fees and to provide for matters incidental thereto.

Provide for the procedures and order of business during all meetings of the Council, including attendance register for Council meetings, no quorum at Council meetings, count of members, minutes of meeting, questions, reports of the Executive Mayor, annual consideration of the budget, motions, member speaking, length of speeches, removal or exclusion of member, no quorum at mayoral committee meetings, participation in discussion at mayoral committee meetings, committees of the council, petitions, adjournment during a meeting, penalty clause and procedures and to provide for matters incidental thereto.

To give effect to the implementation of the Ekurhuleni Metropolitan Municipality’s individual tariff policies and to provide for matters incidental thereto.
