Definition – an aerotropolis is a type of urban form comprising aviation intense business and related enterprises.  It is similar in form and function to a traditional metropolis, where there is a central city core and its commuter-linked suburbs. An aerotropolis has an airport city as its core and is surrounded by clusters of aviation related enterprise.

At present, the EMM has five regional disposal facilities under its jurisdiction, and looking to develop a new facility in the north. The existing facilities are:

  • Simmer & Jack in Germiston
  • Rooikraal in Boksburg
  • Platkop near Heidelberg
  • Weltevreden in Brakpan
  • Rietfontein in Springs

The Kempton Park and Edenvale Customer Care Centres are presently disposing at the Chloorkop waste disposal site, which is a privately owned site. Limited airspace is available until 30 June 2012.

What is Load Shedding?

When there is insufficient power station capacity to supply the demand (load) from all the customers, the electricity system could become unstable, possibly resulting in a national black-out. To avoid this, Eskom can either increase supply or reduce demand.

To increase supply, Eskom will run its power stations at maximum available capacity. In addition to the coal and nuclear plant, hydro and open cycle gas turbine stations are used at peak times when demand is high.

To reduce demand, Eskom will first call on customer contracts that allow for supply to be reduced or interrupted for specific periods and durations. If this is not enough, Eskom is forced to cut supply to all other customers. This could be done through either Scheduled or Emergency Load Shedding.

During Scheduled load shedding parts of the network are switched off according to a predetermined schedule, with the impact spread equitably over the customer base. Shedding is predictable and allows for customers to plan accordingly.

In exceptional circumstances additional Emergency load shedding could be required. Control Centres will shed load using emergency switching in order to protect the network. This will be less predictable and all customers can expect to be affected at any time.

Section 57 contracts explained

According to section 57, a person to be appointed as the municipal manager of a municipality and a person to be appointed as a manager directly accountable to the municipal manager, may be appointed to that position only in terms of a written employment contract with the municipality complying with the provisions of this section and subject to a separate performance agreement concluded annually.

  • The performance agreement must be concluded within a reasonable time after a person has been appointed as the municipal manager or as a manager directly accountable to the municipal manager and thereafter within one month after the beginning of the financial year of the municipality. The employment contract must include, subject to applicable labour legislation, details of duties, remuneration, benefits and other terms and conditions of employment and the performance agreement must include:
  • performance objectives and targets reflected in the annual performance plan which forms an annexure to the performance agreement that must be met,
  • time frames within which those performance objectives and targets must be met;
  • performance objectives and targets that must be practical, measurable and based on the key performance indicators set out in the municipality’s integrated development plan;
  • standards and procedures for evaluating performance and intervals for evaluation; and
  • the consequences of substandard performance.
  • The employment contract for a municipal manager must:
  • be for a fixed term of employment not exceeding a period ending two years after the election of the next council of the municipality;
  • include a provision for cancellation of the contract in the case of non compliance with the employment contract or, where applicable, the performance agreement;
  • stipulate the terms of the renewal of the employment contract, but only by agreement between the parties; and
  • reflect the values and principles referred to in section 50, the Code of Conduct set out in Schedule 2, and the management standards and practices contained in section 51 of the same act (Act no. 32 of 2000).

A municipality may extend the application of the employment contract and/or performance agreement for a municipal manager to any manager directly accountable to the municipal manager according to the agreement between the parties

What are these reports?

In terms of legislation, as well as good governance, it is very important for the organization to produce and publish certain reports.

These report are crucial for all stakeholders in understanding the inner workings and performance of Ekurhuleni. These documents consist of an Annual Report, which coincides with the financial year of the organization (July – June), and is produced annually. The document gives an overview of all activities of the Council, and how funds were used within the community.

The Mid Term Report, is a document that is produced halfway through the political term (local elections are held every 5 years), and reports on the achievements of the Politicians, elect, for the first half of office. The full term Report is similar to the Mid Term Report, except that this report reviews the full 5 year achievements of the Political office.

The Budget report is made public every year , and is accompanied by critical and compulsory interaction with the community and all stakeholders before finalized. The budget document is also made available in a summarized version that is easier to understand, and explains how it would affect the averaged person’s pocket.

Ekurhuleni is a great place to live in and the Municipality is working hard to make it even better. To see to it that all Ekurhuleni residents continue enjoying their freedom in this City, the Municipality has certain rules on how to do things. These rules are called By-Laws and Policies.

What is a By-law?

A By-law is a set of rules or legislation passed by the council of a municipality to regulate matters it is authorised to administer within its area of jurisdiction. A municipality derives the powers to pass a by-law from the Constitution of the Republic of South Africa, which gives certain specified powers and competencies to local government.

Who is responsible for Enforcing Ekurhuleni By-laws and Policies?

The various departments where By-laws regulating matters within their field of responsibility have been passed are responsible for the enforcing of the by-laws and policies in conjunction with the Department of Community Safety in terms of delegated authority from the Council.

Why do we have municipal By-laws?

In terms of the Constitution of the Republic of South Africa a municipality has exclusive municipal executive and legislative authority in its area of jurisdiction to inter alia pass and administer By-laws for the effective administration of matters that it has the right to administer and for its own internal proceedings and arrangements. All the By-laws applicable in the Ekurhuleni Metropolitan Municipality are listed in a register called the Municipal Code.

Process in passing or amending a By-law

 

  1. A need for regulatory measures of a municipal responsibility is identified and a By-law is drafted;
  2. A report detailing the identified need and the draft By-law is submitted to Council for principle approval;
  3. The department that drafted the By-law embark on a comprehensive public participation process – involving all stakeholders and the general community;
  4. A legal process is also followed where public comment on the By-laws is invited – any objections received must be considered by Council;
  5. A final report is submitted to Council for passing of the By-law by majority vote;
  6. The approved By-law is promulgated in the Provincial Gazette on which date or a later date as determined in the By-law, it becomes enforceable in the municipal area of Ekurhuleni.
Just like the laws of the country, the Municipality’s By-Laws and Policies must also be obeyed. It is important to know what these rules are, to ensure we stay on the right side of the law.

The By-Laws adopted since 6 December 2000 by the Ekurhuleni Metropolitan Municipality as well as some of the By-Laws of the disestablished Municipalities in place prior to 6 December 2000 which are still in force, are listed in the Municipal Code.

The jurisdiction of each By-Law is indicated next to its listing in the Municipal Code.

The By-Laws contained in the Municipal Code, are only amended and/ or updated once passed by Council and promulgated in terms of Sections 11, 12 and 13 of the Local Government: Municipal Systems Act, read with Section 7 of the Rationalisation of Local Government Affairs Act.
