NOTICE OF DRAFT RESTRCTION OF ACCESS BY-LAW

CITY OF EKURHULENI METROPOLITAN MUNICIPALITY INVITATION FOR STAKEHOLDER ENGAGEMENT ON THE DRAFT RESTRICTION OF ACCESS BY-LAW

The City of Ekurhuleni Metropolitan Municipality hereby gives notice that a draft by-law to be known as

the City of Ekurhuleni Restriction of Access by-law, 2021 has been prepared by it.

The City of Ekurhuleni Metropolitan Municipality hereby calls upon the members of the public, affected

departments and organs of state in the three spheres of government and all other stakeholders to

participate in the process of drafting the Restriction of Access by-law.

The by-law is enabled by section 156 (2) of the Constitution which gives Municipalities executive authority in respect of, and the right to administer by-laws for the effective administration of the matters which it has the right to administer.  Part B of Schedule 5 the Constitution outlines public spaces as a responsibility of the municipality.

The by-law is necessary and will enable the City to regulate the restriction of access to public places to ensure that the right to equality, freedom of movement, dignity and safety and security is balanced through planning procedures and various other security measures

The objective of the by-law is to:

  • provide procedures, processes and systems necessary to facilitate and regulate restriction of access applications and renewal applications;
  • to provide for appropriate measures to ensure that restrictions of access does not result in discriminating actions nor infringements on the rights of individuals;
  • to provide for penalties associated with non-compliance; and to provide for matters connected thereto.

Commenting period:

From 17 May to 18 June 2021

The draft Restriction of Access by-law will lie for inspection during normal office hours at the following municipal offices or by obtaining an electronic copy from the official website address for the Municipality: www.ekurhuleni.gov.za and
