TRIBUNAL HOLDS HEARING ON MENTAL WELLNESS HOSPITAL APPLICATION
The Ekurhuleni Development Tribunal will, on Tuesday November 3, be considering an application to rezone the Brackendowns Retail Centre to a mental wellness hospital and related uses.
A resounding number (over 800) of objections were received from the community on the application regarding Erf 623, Brackendowns Township, Alberton in Ward 38, and these are expected to be assessed as the hearing.
The Development Tribunal is responsible for matters regarding the planning and development of the City of Ekurhuleni.

PROCEDURE FOR HEARING OF MATTERS BEFORE THE
EKURHULENI DEVELOPMENT TRIBUNAL

THEREAFTER:
Please collect an Official Receipt from: Office No 36, City Planning – Corporate Office, Sanlam Building, Ground Floor,

After R50-00 has been paid at the Rates Hall, Kempton Park Civic Centre, the proof of payment must be produced when collecting the Agenda.
 NB: PLEASE NOTE THAT ALL INFORMATION PERTAINING TO THE APPLICATION CAN BE VIEWED AT THE RELEVANT CUSTOMER CARE AREA, PRIOR TO COLLECTING A COPY OF THE AGENDA.
1. SITE INSPECTION (15 minutes)
 All parties are invited to the inspection (including a delegation of the Tribunal committee and officials from the relevant Departments/Customer Care Areas).
 Procedure:
 Chairperson welcomes all parties;
 Applicant indicates the salient physical features that would strengthen their case (such as densities, traffic, precedents etc.);
 Questions are posed to the applicant;
 Objector/s point out the salient physical features that relate to their objection/s (such as privacy, noise related matters, pedestrians etc.);
 Questions are posed to the applicant.
Please Note:
 No arguments or discussions, in respect of the merits are permitted at the site inspection. These are best left to be discussed at the hearing where all the submissions are recorded.
2. HEARING (the entire process is recorded)
 The chairperson introduces herself/himself and welcomes all to the meeting;
 Legal Advisor introduces the matter, in terms of the applicable legislation;
 All parties introduce themselves for the record. A Power of Attorney/Proxy is required if the original applicant/objector is represented at the hearing by somebody else.
 Any party may raise a point-in-liminé/points of clarification:
 It is advisable that these points be submitted to the Executive Manager: Tribunal and other parties in advance, so as to provide guidance and a fair opportunity to all to be prepared and to save on time;
 Applicant presents his case (15 minutes) (Advisable that submission is also made in writing: 20 copies required)
 May call expert witnesses and lead supporting documentation, or evidence – although this must be arranged beforehand to make provision for additional time;
 Members and objectors may ask questions for clarity, or on the merits of the case (through the Chairperson);
 Objector/s present their case (if there is more than one objector, it is preferable that a spokesperson is used, where possible) (15 minutes) (Advisable that submission is also made in writing: 20 copies required)
 May call expert witnesses and lead supporting documentation, or evidence – although this must be arranged beforehand to make provision for additional time;
 Members and applicant may ask questions for clarity, or on the merits of the objections (through the Chairperson);
 Applicant responds to the objections; (5 minutes)
 Applicant is granted an opportunity for closing remarks (no new matters may be raised) (5 minutes)
 Tribunal deliberates on all aspects and evidence “in committee”, in order to take an informed decision;
 The Tribunal may approve (or approve with amendments after consultation), postpone, refuse, refer back, or delay their decision.
3. POST-HEARING PROCESS
 The minutes of the meeting are finalised at the next meeting of the Tribunal;
 Minutes signed by the Chairperson;
 Minutes referred to the relevant Customer Care Centre;
 Customer Care Centre notifies all parties of the decision in writing;
 The decision is final but in most cases the applicable legislation makes provision for an appeal procedure to the Townships Board. (Provincial Body)
